Rajasthan BJP: In the case involving the resignation of 81 members of the Rajasthan Legislative Assembly, independent MLA Sanyam Lodha represented the Rajasthan Legislative Assembly in the Rajasthan High Court on a PIL filed by BJP Legislative Party Deputy Leader Rajendra Rathore. A stage before the Speaker’s decision is taken. Under Rule 157 of the Rules of Business and Procedure, a proposal to break the privilege has been submitted to the Secretary of the Rajasthan Legislative Assembly, Mahavir Sharma. Lodha sought permission to raise it in the House on January 24 in the assembly that begins on January 23.
The provision of Article 190(3)(b) is mentioned
MLA Lodha referred to Article 190 (3) (b) of the Constitution of India, which deals with the breach of privilege law related to the letter of resignation. Similarly, Rule 173 (2) of the Rules of Procedure and Proceedings of the Rajasthan Legislative Assembly was also mentioned in the motion related to the resignation letter of the members.

Lodha said that the decision was considering the resignation of members and the Speaker had not taken any decision in this regard. Even earlier, by filing a Public Interest Litigation in the Supreme Court on December 1, 2022, not only the Speaker of the Legislative Assembly was defamed, but also the special rights of the Rajasthan Legislative Assembly were violated. Through this motion, Lodha sought permission to raise a resolution on violation of special rights in the Rajasthan Legislative Assembly on January 24.
