Allahabad High Court : The Allahabad High Court has recently approved the bail plea of Hindu Sena general secretary Digvijay Choubey, accused of inciting people to demolish the Gyanvapi mosque in Varanasi, Uttar Pradesh. The court has also stayed the arrest of Digvijay Choubey. A case under sections 153A, 29A, 505(2) of IPC has been registered against Digvijay Choubey at Bhelupur police station in Varanasi.
What were the allegations against Digvijay Choubey?
The single bench of Subhash Chand Sharma of Allahabad High Court has granted anticipatory bail to Digvijay Choubey till the police charge sheet is filed. The accused, Digvijay Choubey, was booked under the Indian Penal Code (IPC) for promoting enmity between two groups after he allegedly incited the public to demolish the Gyanvapi mosque.
Judge Justice Subhash Chandra Sharma granted anticipatory bail on a personal bond of Rs 25,000. Significantly, last year in August 2022, Digvijay Choubey wanted to perform Jalabhishek and worship in the Gyanvapi disputed mosque. During this, when Digvijay Choubey was stopped, he threatened to make the condition of the mosque like Babri Masjid and talked about its demolition. After this, a case was filed against him. Digvijay had filed an anticipatory bail petition in the Allahabad High Court to avoid arrest.
Chaubey’s name was not in the FIR, it was added later
Digvijay Choubey’s counsel argued before the court during the hearing of the case that the FIR in this case was registered against Arun Pathak who is the President of Vishwa Hindu Sena. Choubey’s name was not initially in the FIR, but was added later during the investigation. While there was no concrete evidence to prove his role.
The lawyer also said during this time that if Choubey is released on bail, he will not misuse the liberty of bail and will cooperate in the investigation. While the State’s counsel opposed the prayer for anticipatory bail.
